1. Introduction

The terms and conditions set out below (“Conditions”) apply to everybody who use this web site (“SITE) and related websites including the use of the information offered on the Site and/or related website. Anybody using the Site shall be deemed to be bound by these conditions.

The Site makes available information relating to hotels, resorts, timeshare properties and also other properties owned or managed by GGL HOTEL & RESORT COMPANY Limited, a Company constituted under the Indian Companies Act, 1956 and/or its subsidiaries, controlled entities, affiliates and related parties (“Ffort”).

3. TradeMarks

The Site contains “Ffort” trade and service marks and devices (including the word “Ffort”) and other valuable trade or service marks owned by Ffort or licensed to Ffort to distinguish its services and products. These trade and service marks and related intellectual property are protected from copying and simulation under laws of India.

The user of the Site must not (without limitation) use any of the trade or service marks of Ffort, in any manner whatsoever, which may appear to be confusing, misleading or deceptive to the world at large.

4. Copyright

The information, text, graphics, images, sounds, links and all other information and software published or otherwise contained in the Site (collectively “Information”) are either owned exclusively by Ffort or licensed by Ffort and except as specifically provided herein, these cannot be copied, distributed, displayed, reproduced or transmitted, in any form or by any means whether electronic, mechanical, photocopying, recording, or otherwise, without the prior written approval of Ffort.

The user may not (Without limitation) create derivative works from any part of the Site or commercialise any Information, products or services obtained from any part of the Site without prior written approval from Ffort.

5. Use

The Site is for the user’s personal and non commercial use and the downloading or printing of any information by the user shall be only for such personal and non-commercial purposes.

 

The user shall use the Information only as a licensee and such user shall not, under any circumstances, be construed as transfer of title.

 

The information etc. are to be used for lawful license purposes only and are not to be used for any commercial purpose or public display, performance, sale or rental; nor can be transferred to another person in any manner whatsoever.

Ffort is not liable for any loss (direct or indirect) resulting from any action taken or reliance made by the user on the Information or any other material accessed through the Site including via any Linked Web Site. The user must make his own inquiries and seek independent professional advice before acting or relying on any such information or material.

 

Ffort may, from time to time, update, modify or add to or delete the Information, including these Conditions and absolutely reserves the right to make such changes without any obligation to notify past, current or prospective users of the Site.

 

Unless otherwise specified to the contrary all new Information shall be subject to these Conditions.

 

The Site may not operate continuously or without interruption and may be suspended or discontinued, without or particularly, at any time without the Ffort being liable for any direct or indirect loss to anybody as a result of such action.

7. Liability, Disclaimer & Exclusion

Ffort shall, in no event, be responsible for any loss or damage, of any nature whatsoever, arising, whether in contract, tort or otherwise, which may be suffered by the user in connection with or arising out of use of the Site or any Linked Web Site by the User or arising out of use of or reliance on Information or any other material accessed through the Site including, without limitation, loss or damage by way of loss of profits, loss of business opportunity, business interruption or loss of information etc.

 

The liability, arising out of any applicable law, if, and to the extent, such liability cannot be lawfully excluded are not excluded under these conditions provided however, to the extent permitted by law, all warranties, terms or conditions which would otherwise be implied into these Conditions, are hereby excluded.

 

In case any warranty, term or condition under any applicable law, and that law prohibits exclusion or modification of the application of or the liability of Ffort under, any such warranty, term or condition, then the liability of Ffort shall include liability for that warranty, term or condition but such liability will be limited specifically for a breach of that warranty.

8. Specific Cautions

The user must ensure that the user’s access to and use of the Site is not illegal or prohibited by laws which apply to the user.

 

The user must take own precautions that the process which the user employ for accessing the Site does not expose the user to the risk of virus, malicious computer code, computer program routine or process or other forms of interference which may damage the user’s own computer system. The user should be responsible for ensuring that the user’s own computer system meets all relevant technical specifications necessary to use the Site and is compatible with the Site. For the removal of doubt, Ffort does not accept any responsibility whatsoever for any interference or damage to the user’s own computer system which arises in connection with use of the Site or any Linked Web Site by the user.

 

Ffort does not guarantee or warrant that any material available for downloading from the Site or any Linked Web Site will be free from any virus, infection or other condition which has contaminating or destructive properties. The user shall be responsible for taking sufficient precautions and checks to satisfy the user’s own particular requirements for accuracy of data input and output.

 

It must be ensured by the user that any information which the user provide to the Ffort is accurate and complete and does not contain any virus, malicious computer code, computer program routine or process or other form of interference which may damage the computer system of the Ffort or the Information or which may detrimentally interfere with or surreptitiously intercept or expropriate any system installed and obtained by Ffort as also data and information.

9. Linked Websites

The Site may contain links to other web sites ("Linked Web Sites"). Those links are provided for convenience only and may not remain current or be maintained.

 

The user agree that Ffort does not have any control over the content or availability of Linked Web Sites and accepts no responsibility for the content, privacy practices or any other aspect of Linked Web Sites.

 

Links with Linked Web Sites should not be construed as an endorsement, approval or recommendation by Ffort of the owners or operators of those Linked Web Sites, or of any information, graphics, materials, products or services referred to or contained on those Linked Web Sites, unless and only to the extent expressly stipulated to the contrary.

10. Reservations

The reservations feature of the Site is provided solely to assist customers in determining the availability of travel related services and products of the Ffort and to make legitimate reservations for such products and services of the Ffort and for no other purpose.

 

The user warrant that the user is at least of 18 years of age, possess the legal authority to enter into a legal agreement constituted by the user’s acceptance of these Conditions and to use the Site in accordance with such Conditions.

 

The user agree to be financially responsible for use of the Site including, without limitation, for all reservations made by the user or on user account for the user, whether authorised by the user or not. For any reservations or other services for which fees may be charged, the user agree to abide by the terms or conditions of supply including, without limitation, payment of all moneys due under such terms or conditions.

 

The Site contains details of charges and room rates (including any available special offers) for the hotels, resorts and timeshare properties etc. owned or managed by Ffort.

 

Reservation and the terms and conditions of booking are set out on the Site and payment will be in accordance with the procedure set out in such terms and conditions.

 

No contract will subsist between the user and Ffort or any of its affiliates in respect of any services or products offered through the Site unless and until Ffort accepts your order by e-mail or automated confirmation through the Site confirming that it has accepted your reservation, booking or order and any such contract shall be deemed to incorporate the reservation terms and conditions of booking. Any other relevant terms and conditions relating to particular services or products are set out in the Site.

 

The user undertake that all details which the user provide to in connection with any services or products which may be offered by Ffort on the Site (including room reservations) will be correct and, wherever applicable, the credit card which the user is using is owned by the user and that there are sufficient funds to cover the cost of any services or products which the user wish to purchase. Ffort reserves the right to obtain validation of the credit card details before providing the user with any services or products.

11. Security & Non Confidentiality

It is clearly understood and accepted by the user that electronic transmissions of data including the Internet are public media and any use of such media is public not private.

 

It is further understood and accepted by the user that information related to or arising from such use is either public or the property of those collecting the information and not personal or private information.

 

Ffort does not warrant and cannot ensure the security or confidentiality of any information which the user transmit to Ffort. Accordingly, any information which the user transmit to Ffort is transmitted at the user’s your own risk.

12. Termination of Access

Breach of any of these Conditions by the user will immediately terminate the license of the user to use the Site without the necessity of any notice being given to you.

 

Otherwise access to the Site may be terminated at any time by Ffort without notice.

 

The provisions of these Conditions excluding, limiting and disclaiming the liability of Ffort will nevertheless survive any such termination.

13. General

Ffort does not accept any liability for any failure by Ffort to comply with these Conditions where such failure is due to circumstances beyond its reasonable control.

 

If Ffort waives any rights available to it under these Conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.

 

If any of these Conditions are invalid, unenforceable or illegal for any reason, the remaining Conditions shall nevertheless continue in full force.

 

The user shall be completely responsible for all charges, fees, duties, taxes and assessments arising out of the use of the Site.

14. Governing Law & Jurisdiction

These Conditions are governed by the laws in force in India and the user agree to submit to the exclusive jurisdiction of the competent courts only at Kolkata, India.
